Terms of service

Sect. 1 Scope of validity, customer information

The following general terms and conditions (GTC) govern the contractual relationship between Hurom Europe GmbH and consumers or entrepreneurs who purchase goods in the online shop "Dahlert by Hurom" at www.dahlert.com (the "online shop"). Your contracting party is in every case Hurom Europe GmbH. Terms and conditions of the customer that conflict with or deviate from these GTC do not become part of the contract unless we have expressly agreed to them in text form. All prices shown are total prices including statutory VAT; for deliveries to other EU Member States, VAT is charged at the rate applicable in the country of destination. Shipping costs are shown separately and before you place your order (Sect. 5). The prices applicable are those displayed at the time you place your order. These GTC are available in German and English (contract languages). The version in the language in which you complete the order process applies to your contract.

Sect. 2 Conclusion of contract

(1) The presentation of products in our online shop does not constitute a binding offer. It is a non-binding invitation to you to place an order (invitatio ad offerendum).

(2) You can put one or more products into the cart. In the course of the order process, you enter your data and your choices concerning payment method, delivery method, etc. By clicking the order button you submit a binding offer to purchase the products contained in the cart. Immediately before you submit the order we display, in a highlighted manner, the essential characteristics of the goods and the total price including taxes and delivery charges.

(3) Immediately after your order we will send you an email confirming your order (order confirmation). By that order confirmation we accept your offer, and the contract of sale is thereby concluded. The order confirmation also serves as the confirmation of receipt required by Section 312i(1) sentence 1 no. 3 of the German Civil Code. Together with it we send you the contractual text referred to in Sect. 3, the withdrawal instructions and the withdrawal form.

(4) Where you choose a payment method under which the price is charged before dispatch, the amount is charged on the basis of the contract concluded under paragraph (3). If we are exceptionally unable to fulfil your order, we will refund the amount without undue delay, in full and without deduction.

Sect. 3 Customer information: Storage of the contractual text

We store the text of the contract, including the order details and these GTC, and send it to you together with the order confirmation by email in a form that you can save and print (durable medium).

Sect. 4 Customer information: Correction note

You can modify your entries at any time before submitting the order by using the 'delete' key. We will keep you informed throughout the checkout process of further correction options. You can also terminate the order process at any time by closing the browser window completely.

Sect. 5 Delivery, shipping costs, undeliverable shipments

(1) Delivery area. We deliver only to the twelve countries listed in the table below. Delivery is available only within the continental European Union. We do not deliver to territories outside the European continent, even if they belong to an EU Member State — such as the French overseas territories (e.g. Réunion, Guadeloupe, Martinique, French Guiana, Mayotte) or the Spanish territories outside Europe (e.g. Canary Islands, Ceuta, Melilla).

(2) Shipping costs. Shipping costs are determined by the destination country and the applicable shipping zone:

Shipping Zone Destination Countries Shipping Fee Free Shipping
Zone 0 Germany €7 Orders of €69 or more
Zone 1 Luxembourg, Croatia, Italy, Netherlands, Austria €12 Orders of €69 or more
Zone 2 Spain, France €15 Orders of €79 or more
Zone 3 Belgium, Latvia, Portugal €20 Orders of €99 or more
Zone 4 Sweden €25 Orders of €149 or more

All amounts stated above are final prices including statutory value added tax.

(3) Delivery time. Unless a delivery date is expressly agreed, we will dispatch the goods without undue delay and hand them over to you no later than 30 days after conclusion of the contract. Delivery dates shown during the order process are estimates based on the carrier's standard transit times. Where a delay is caused by the carrier or by circumstances outside our control, we will inform you without undue delay. Your statutory rights in the event of delay remain unaffected.

(4) Shipping damage. If the shipment is visibly damaged on arrival, please refuse it if possible. Please report damaged or missing items to info@dahlert.com, if possible within three days of delivery and with photos, and keep the packaging; this helps us pursue claims against the shipping provider. Your statutory rights remain unaffected; a later report does not limit them.

(5) Undeliverable shipments and reshipment. If a shipment cannot be delivered and is returned to us, the following provisions apply depending on the reason for the return. These provisions apply only to undeliverable shipments and do not affect the consumer's statutory right of withdrawal.

(a) Non-delivery due to an error by the shipping provider. If a shipment is returned to us due to an error by the shipping provider, the customer will not incur any additional costs. If the customer requests cancellation of the order, the purchase price will be refunded in full. If the customer requests a new delivery, we will resend the order at no additional cost.

(b) Cancellation after shipment, refusal or failure to collect. If an order is cancelled after the goods have already been handed over to the shipping provider, or if a correctly addressed shipment is refused by the customer or is not collected within the period specified by the shipping provider, and the shipment is therefore returned to us, the flat-rate charge for the return transport of the undeliverable shipment to us set out in the table "Return transport of undeliverable shipments" below may be deducted from the refund amount.

(c) Non-delivery due to an incorrect or incomplete delivery address provided by the customer. If a shipment cannot be delivered because the customer provided an incorrect, incomplete or inaccurate delivery address, and the shipment is therefore returned to us, the customer will be charged only the flat-rate charge set out in the table "Return transport of undeliverable shipments" below for the return transport of the undeliverable shipment to us. If the customer cancels the order, this flat-rate charge will be deducted from the refund amount. If the customer requests a reshipment, the customer will be charged this flat-rate charge. Reshipment will be arranged only after payment of this amount has been received. We will cover the cost of one subsequent reshipment. The customer is not entitled to further free reshipment attempts. If the customer fails to provide a corrected delivery address within 14 days after being requested to do so, we are entitled to terminate the contract and refund the purchase price less this flat-rate charge.

Return transport of undeliverable shipments (applies only in cases (b) and (c))

Country Flat-rate return-transport charge
Germany €5.47
Other destination countries (EU) €11.90

The amounts above are flat-rate charges for the transport of the shipment back to us. They apply only in the cases set out in (b) and (c), that is, only where the non-delivery is attributable neither to us nor to the shipping provider; in the case of (a) you incur no costs. You are expressly permitted to prove that we have suffered no loss at all or a loss substantially lower than the flat-rate charge; in that case no amount, or only the lower amount, will be charged. We do not charge more than the amounts stated above. No flat-rate charge is made where you refuse acceptance because the shipment is visibly damaged, the goods are defective, or the delivery does not match your order. If you withdraw from the contract, only the rules set out in our Right of Withdrawal policy apply; no flat-rate charge under this table will be made in that case. Statutory claims that are not based on the withdrawal but on your having provided an incorrect or incomplete delivery address remain unaffected.

Sect. 6 Retention of title

The merchandise remains our property until full payment is made.

Sect. 7 Statutory liability for defects (statutory warranty)

(1) The statutory rights in respect of defects apply to all goods purchased from us (Sections 434 et seq. German Civil Code). The limitation period is two years from delivery of the goods; it is extended in accordance with the statutory provisions, in particular once by twelve months where a defect is remedied by repair (Section 475e German Civil Code). Any further mandatory rights under the law of your country of habitual residence remain unaffected (Sect. 12). Exercising these rights is free of charge for you.

(2) Where a defect becomes apparent within one year of delivery, it is presumed that the goods were already defective at the time of delivery. Within that period you do not have to prove that the cause was already present when the goods were handed over.

(3) In the event of a defect you may first request supplementary performance, that is to say repair of the defect or delivery of goods free of defects. If supplementary performance fails, is impossible or is refused by us, you may withdraw from the contract, reduce the purchase price or claim damages.

(4) We bear the expenses necessary for the purpose of supplementary performance, in particular transport, travel, labour and material costs. For returns made under the liability for defects we provide you with a free return label; the return shipping fees stated in our Right of Withdrawal policy do not apply, nor is a flat-rate charge under Sect. 5(5) charged.

(5) How to proceed: write to us at info@dahlert.com and state your order number, a short description of the defect and, where possible, photographs or a short video. We will get back to you and send you a return label where appropriate. The return address is: KS Global GmbH (Gate B), Am Holzweg 28–34, 65830 Kriftel, Germany.

(6) Your statutory claims for damages remain unaffected; our liability for damages is governed by Sect. 8 and by mandatory statutory provisions, in particular the German Product Liability Act (Produkthaftungsgesetz).

Sect. 8 Limitation of liability

We exclude liability for slightly negligent breaches of duty, provided such breach does not involve essential contractual obligations, injury to life, body or health, or guarantees, and provided it does not affect claims under the Produkthaftungsgesetz (ProdHaftG, Product Liability Act). Essential contractual obligations are those obligations whose fulfilment is necessary to achieve the purpose of the contract and on whose observance you may regularly rely; they include in particular our obligation to deliver the item and to transfer title, free of material and legal defects. In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the damage foreseeable and typical for this type of contract. The same applies to breaches of duty by our legal representatives, employees and other vicarious agents (Erfüllungsgehilfen), including the providers of the technical infrastructure we use. The above limitations also apply to the personal liability of our legal representatives, employees and vicarious agents. Liability for the fraudulent concealment of a defect remains unaffected.

Sect. 9 Disposal of electrical and electronic equipment

(1) Electrical and electronic equipment must not be disposed of with household waste. Consumers are legally obliged to dispose of old equipment separately from unsorted municipal waste, as indicated by the crossed-out wheelie bin symbol on the appliance, its packaging or in the user manual.

(2) Old batteries and lamps which are not enclosed by the appliance must be removed from the appliance before it is handed in and must be disposed of separately.

(3) Deleting personal data stored on the old appliance before disposal is your responsibility as the end user.

(4) Take-back by us. If you wish to return an old appliance, please contact us at info@dahlert.com. We will then inform you, free of charge, of the return options available in your country of delivery. When you buy a new appliance, we take back one old appliance of the same type free of charge (1:1 take-back). Small appliances with no external dimension exceeding 25 cm are taken back free of charge even without a new purchase (0:1 take-back), limited to three appliances per type of appliance. In addition, old electrical appliances can also be returned free of charge at nearby municipal collection points (such as local recycling centres).

Sect. 10 Right of withdrawal

If you are a consumer, you have a statutory right to withdraw from the contract within 14 days. The conditions, the period and the procedure for exercising this right, together with the withdrawal form, the return address and the return shipping fees, are set out in full in our Right of Withdrawal policy, which forms part of this contract and is provided to you before you place your order and again with our order confirmation.

Sect. 11 Consumer dispute resolution

Hurom Europe GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of the German Act on Alternative Dispute Resolution in Consumer Matters (VSBG). We are always happy to resolve any issue with you directly: info@dahlert.com

Sect. 12 Further customer information, applicable law

The following documents apply in addition to these GTC and can be viewed and downloaded on our website at any time: these GTC · Right of Withdrawal · Withdrawal Form · Privacy Policy · Legal Notice.

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). With respect to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence (principle of favourability).
